Terms of Use

The French version of these Terms of Use is the official version of the ASPQ Terms of Use. In the event of any discrepancy between the French version and a translated version, the French version shall prevail. This English translation is provided for information purposes only.
The same applies to the ASPQ Privacy Policy, Cookie Management Policy, and Netiquette Policy. Where these Terms of Use refer or link to any of those policies, the French version of the applicable policy shall prevail in the event of any discrepancy with a translated version.
Welcome to the websites and digital platforms of the Association pour la santé publique du Québec (ASPQ).
These Terms of Use govern access to and use of the websites, digital platforms, user accounts, interactive tools and other online services administered or coordinated by ASPQ, including those associated with its affiliated projects, campaigns and initiatives (collectively, the “ASPQ Platforms”).
By accessing or using the ASPQ Platforms, you acknowledge that you have read these Terms of Use and agree to comply with them. If you do not agree to these Terms, please stop using the ASPQ Platforms.
Certain features, activities or platforms may be subject to additional rules or terms. Where applicable, these additional rules or terms will be provided to you before you register for or use the relevant service.
These Terms of Use apply to all websites, digital platforms, projects, campaigns, online services and initiatives administered or coordinated by ASPQ, whether they are specifically identified in these Terms.
They supplement the following documents:
- the ASPQ Privacy Policy;
- the Cookie Management Policy;
- the ASPQ Netiquette Policy;
- any specific rules that apply to a particular activity, contest, platform or service.
If there is any inconsistency, the specific terms provided in connection with an activity or service will prevail with respect to that activity or service.
The ASPQ Platforms are primarily intended to:
- inform and raise public awareness;
- make knowledge about sustainable health, prevention and health promotion accessible and understandable;
- provide publications, tools, training and activities;
- encourage public participation, knowledge sharing and mobilization;
- present ASPQ’s projects, campaigns and positions;
- provide certain interactive features and information, support or referral services.
Content may include text, publications, guides, tools, training materials, podcasts, videos, personal stories and testimonials, illustrations, infographics, forms and downloadable resources.
Information made available through the ASPQ Platforms is provided for general informational, educational, explanatory and public-awareness purposes.
Some content may address medical, legal, social or administrative matters. Unless expressly stated otherwise under a specific mandate or agreement, such content:
- does not constitute a diagnosis, treatment or medical advice;
- does not constitute legal advice tailored to a particular situation;
- does not create a relationship between a health professional and a patient;
- does not create a lawyer-client relationship;
- is not a substitute for consultation with a qualified professional.
Laws, public policies, scientific knowledge and professional practices may change over time. General information should therefore not be relied on as the sole basis for a medical, legal or administrative decision.
As part of certain projects, including Victimes des pesticides du Québec and Rights and Pregnancy (Droits et grossesse), ASPQ may provide information, support or referrals to relevant resources.
The nature and scope of these services are described in the communications, forms or documents specific to the relevant project. Unless a written agreement expressly states otherwise, these services do not constitute legal representation, medical advice, a diagnosis or professional care.
In a medical emergency or where there is immediate danger, contact the appropriate emergency services. For advice tailored to your circumstances, consult a health professional, lawyer or other qualified resource.
ASPQ takes reasonable steps to provide information that is reliable, relevant and up to date. However, it cannot guarantee that all content will at all times be complete, error-free or suitable for a particular situation.
You should consider when content was published or last updated. ASPQ may, without notice:
- correct or update content;
- change the appearance or functionality of a Platform;
- withdraw, archive or replace a publication;
- suspend or discontinue an activity or online service.
Information obtained from third parties is presented based on the sources available at the time of publication. Users are responsible for verifying important information with official sources or qualified professionals.
ASPQ takes reasonable steps to keep its Platforms accessible and operational. However, it does not guarantee continuous, uninterrupted or error-free access.
Access may be suspended or restricted due to:
- maintenance or updates;
- technical issues;
- a security incident;
- circumstances beyond ASPQ’s control;
- use that does not comply with these Terms.
You are responsible for ensuring that you have the compatible device, Internet connection, browser and software required to access the ASPQ Platforms.
Certain Platforms may require you to create an account or may provide interactive features.
When you create or use an account, you agree to:
- provide accurate and up-to-date information;
- keep your login credentials and passwords confidential and secure;
- not share your account with anyone who is not authorized to use it;
- promptly notify ASPQ of any unauthorized use or security issue;
- use the Platform in accordance with these Terms and any applicable specific rules.
Subject to applicable law, you are responsible for activity carried out through your account.
ASPQ may suspend or close an account where it has reasonable grounds to believe that the account is being used fraudulently, is compromising the security of a Platform or is being used in breach of these Terms.
You must use the ASPQ Platforms lawfully, respectfully and in a manner consistent with their intended purpose.
You must not:
- interfere with the security, operation or integrity of a Platform;
- attempt to gain unauthorized access to an account, system or information;
- introduce a virus, malware or other harmful code;
- use a bot, automated tool or bulk data-scraping method without authorization;
- impersonate another person or knowingly provide false information;
- post or transmit content that is unlawful, threatening, hateful, discriminatory, harassing, defamatory, deceptive or infringes the rights of others;
- collect or use another person’s personal information without authorization;
- infringe copyright, trademarks or other intellectual property rights;
- use the Platforms for unauthorized commercial, advertising or solicitation purposes (see “Permitted Uses”).
ASPQ may remove content, restrict a feature or suspend access where it reasonably determines that use of a Platform violates these Terms, the ASPQ Netiquette Policy or applicable law.
To the extent permitted by law, you may be required to compensate ASPQ or a third party for harm caused by unlawful use of the Platforms, a breach of these Terms or an infringement of another person’s rights for which you are responsible.
This provision does not limit any other remedies available under law.
The ASPQ Platforms may contain links to websites, documents, applications or services operated by third parties.
These links are provided to make it easier to access additional information or services. Their inclusion does not mean that ASPQ endorses all of the content, practices or services provided by those third parties.
When you access an external service, that third party’s terms of use and privacy policies apply. ASPQ does not control these services and encourages you to review their terms before providing them with personal information or entering into a transaction.
ASPQ maintains a presence on various social media platforms. ASPQ’s social media accounts are hosted and operated by third parties, whose terms of service and privacy practices also apply.
Interactions on ASPQ accounts must comply with the ASPQ Netiquette Policy. ASPQ may hide or delete a comment and, where warranted, block or report an account that posts, in particular:
- hateful, discriminatory, threatening or harassing content;
- another person’s personal information;
- defamatory or clearly false statements;
- commercial, repetitive or irrelevant content;
- unlawful content or content that infringes the rights of others.
Moderation is carried out based on the circumstances and does not mean that ASPQ is required to continuously monitor all comments posted on its accounts.
When you submit a comment, photograph, testimonial, document or other content to ASPQ, you remain responsible for that content.
By submitting content, you confirm that:
- you have the right to submit it;
- submitting it does not infringe another person’s rights;
- you have obtained all necessary consents where it includes the image, voice or personal information of a third party;
- it does not contain anything unlawful or harmful.
Submitting content to ASPQ does not automatically grant ASPQ the right to publish it or otherwise use it publicly. Where ASPQ wishes to publish a testimonial, photograph, recording or other personal content, it will obtain the authorizations and consents required in those circumstances.
Where a form, contest, activity or Platform includes specific terms governing the use of submitted content, those terms apply in addition to these Terms.
Unless otherwise stated, the text, publications, tools, documents, videos, podcasts, illustrations, photographs, graphic elements, trademarks, logos and other content made available through the ASPQ Platforms are owned by ASPQ or used with the permission of their respective rights holders.
Informational content and downloadable materials may generally be viewed, downloaded, copied or printed for personal, research, educational or non-commercial purposes, if you:
- do not modify them in a way that could alter their meaning;
- do not present them out of context or in a misleading manner;
- do not use them for commercial purposes except as otherwise permitted;
- clearly identify ASPQ as the source;
- retain all copyright notices and other notices appearing on the material.
Brief quotations may be reproduced where permitted by law, provided that the source is clearly identified.
Except where permitted by law, ASPQ’s prior written permission is required to:
- reproduce a publication in full;
- modify, adapt or translate content, or create a derivative work;
- incorporate content into a commercial product or service except as otherwise permitted;
- reuse a photograph, illustration, infographic or multimedia content;
- use ASPQ’s name, logo, trademark or visual identity;
- imply that ASPQ endorses, sponsors or recommends any person, organization, product or service.

ASPQ may use tools powered by artificial intelligence to support its activities, including for transcription, summarization, drafting, analysis, translation or content processing.
The use of these tools is governed by ASPQ’s internal practices and, where personal information is involved, by its Privacy Policy and its Politique de gouvernance et de protection des renseignements personnels.
Despite the review and verification measures taken, content prepared or processed with the assistance of a technological tool may contain inaccuracies. Important information should be verified against the cited sources or with an appropriate qualified resource.
You must not use ASPQ content or Platforms to develop, train or operate an automated system in a manner that infringes ASPQ’s rights, the rights of others or applicable law.
ASPQ’s collection, use, disclosure, retention and protection of personal information are governed by its Privacy Policy.
The Privacy Policy explains, among other things:
- what personal information ASPQ may collect;
- the purposes for which it may be used;
- the individuals or organizations with whom it may be shared;
- the measures taken to protect it;
- the rights of the individuals concerned.

The ASPQ Platforms may use cookies, tracking pixels and similar technologies to support their operation, measure their use and improve the browsing experience.

To the extent permitted by applicable law, ASPQ will not be liable for harm arising solely from:
- the use of, or inability to use, its Platforms;
- reliance on general information without appropriate verification;
- an interruption, technical error or failure beyond its control;
- access to a website, document or service operated by a third party;
- unauthorized use or use that violates these Terms.
Nothing in this provision excludes or limits liability that cannot lawfully be excluded or limited, including liability for intentional or gross fault or for bodily or moral injury.
ASPQ may amend these Terms to reflect changes to its Platforms, activities, practices or applicable legal requirements.
The most recent version will always be available through the ASPQ Platforms. The date of the latest update appears at the beginning of this document.
These Terms are governed by and construed in accordance with the laws in force in Québec and the federal laws of Canada applicable therein.
Subject to any mandatory provisions of applicable law, any dispute relating to these Terms or the ASPQ Platforms will be subject to the jurisdiction of the competent courts in the judicial district of Montréal, Québec.
If any provision of these Terms is found to be invalid, illegal or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
